
Gander Terms of Use

Welcome to the Gander Terms of Use (the “Terms”)!
These Terms govern your access and use of the Gander Social Inc. (“Gander”, “we”, “us” or “our”) social media mobile application (the “App”) and website (the “Site”, and together with the App, the “Services”). By accessing the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
THESE TERMS CONSTITUTE A BINDING AGREEMENT BETWEEN YOU AND GANDER, AND CONTAIN CLAUSES THAT LIMIT GANDER’S LIABILITY. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.
- Community Governance; Accessibility
- Community Governance. Gander is a benefit company incorporated under the laws of the Province of British Columbia. Gander is committed to conducting its business in a responsible and sustainable manner to build trustworthy social infrastructure that protects user dignity, advances digital sovereignty, and strengthens democratic participation in the digital public sphere. In pursuing this goal, Gander’s policies may be shaped by advisory councils or public interest bodies.
- Accessibility. Gander is committed to making our Services accessible to as many people as possible. We aim to design, build, and maintain the Services to meet Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards, and we work to improve accessibility over time as our Services evolve.
- Accessing and Using the Services
- Grant. Gander grants you a personal, worldwide, non-transferable and non-sublicensable right to access and use the Services in accordance with these Terms and any other Gander policies referenced herein, as updated from time to time.
- Your Promises. By accessing and using the Services, you represent and warrant that: (a) you are at least 18 years old if you are accessing the Services in Canada, or you are otherwise at least the applicable age of majority in the jurisdiction from which you are accessing the Services; (b) you are able to form legally binding contracts; (c) if you are accessing and using the Services on behalf of an entity, you are authorized to bind such entity to these Terms; and (d) with respect to all information and content that you provide, post, display or create on or through the Services, directly or indirectly (the “User Content”): (i) the User Content is accurate; (ii) you own or otherwise control all necessary rights to provide such User Content to Gander for use with the Services; and (iii) such User Content (including any derivative works thereof) will not infringe any Intellectual Property Rights, privacy rights or contractual rights of any third party.
- User Accounts
- Creating and Maintaining User Accounts. You must create an account in order to use the Services (a “User Account”). You are solely responsible for: (i) all content posted and activity that occurs under your User Account; (ii) providing Gander with accurate and updated information, as necessary from time to time, in order to keep your User Account updated; and (iii) keeping your password and log-in information for your User Account secure and confidential.
- Suspension / Termination of User Accounts. Gander may, in its sole discretion, suspend or terminate your User Account if you do not comply with these Terms, without limitation to any other remedies available to Gander. Additionally, Gander may terminate User Accounts: (i) that have been created by bots or any other automated method; (ii) that have been inactive for a long time; (iii) that have been created or used for any reason apart from the good faith use of the Services in accordance with their ordinary intended purpose; (iv) in the event of a modification or termination of the Services; and (v) in any other circumstance as Gander determines is necessary, in its sole discretion.
- Responsible Use
In accessing and using the Services, you must not:
- breach or circumvent any applicable laws or any third party rights;
- post User Content that is:
- for the purpose of political advertising;
- for the purpose of promoting extremism, terrorism or organized hate;
- for the purpose of promoting self-harm or suicide;
- materially false, inaccurate, misleading or deceptive in a way that is likely to cause harm or confusion;
- abusive, harassing, threatening or hateful;
- defamatory;
- indecent or sexually explicit;
- graphically violent;
- illegal; or
- infringing the rights of other people.
- Gander may allow User Content that is generated, altered, or manipulated using artificial intelligence or other tools, including where it could be confusing or misleading, provided that it is clearly disclosed or labeled as such where required by Gander (for example, using any AI labeling tools or disclosures we make available). You must not remove, obscure, or falsify any labels or disclosures applied by the Services, and you must not present synthetic, manipulated, or out-of-context media as authentic where doing so is likely to cause harm or confusion (including fraud, impersonation, or misinformation); and
- Gander may implement technical controls on the Services that allow for age-gating, labeling, filtering, and user-directed visibility settings for content (“Technical Controls”). Upon implementation of such Technical Controls, and subject to any additional terms and disclosures required by Gander from time to time, users may obtain the ability to upload, post, transmit, or otherwise make available through the Services pornographic or sexually explicit content, or content that is primarily intended to elicit sexual arousal (“Adult Content”). For clarity, Adult Content includes visual depictions of nudity or sexual activity, sexually explicit audio, fetish content, or any other material that would reasonably be considered adult-oriented under applicable laws or app store requirements. However, notwithstanding any Technical Controls, Gander may at any time, in its sole discretion, remove or restrict any content that it determines to constitute Adult Content.
- impersonate other individuals or entities in a fraudulent manner;
- misuse reporting or moderation systems implemented on the Services;
- transfer, sell or license your User Account to another party, including, but not limited to, your username;
- distribute or post spam, unsolicited or bulk electronic communications, chain letters or pyramid schemes;
- distribute viruses or any other technologies that may harm the Services or other users;
- use any robot, spider, scraper, data mining tools, data gathering and extraction tools, or other automated means to access our Services for any purpose;
- interfere with the working of our Services, or impose an unreasonable or disproportionately large load on our infrastructure;
- infringe the copyright, trademark, patent, publicity, moral, database and/or other intellectual property rights (collectively “Intellectual Property Rights”) that belong to or are licensed to Gander;
- infringe any Intellectual Property Rights that belong to third parties affected by your use of the Services or post content you are not authorized to post;
- harvest or otherwise collect information about other users without their consent;
- circumvent any technical measures we use to provide the Services or take any action to violate, interfere with or undermine the security or system integrity of the Services;
- reproduce, copy, modify, adapt, exploit for commercial purposes, license, sublicense, distribute, transmit, translate, reverse engineer, or create derivative works of, the Services or the content therein or any part thereof except (i) with Gander’s prior written consent, or (ii) in the ordinary and prescribed use of the Services, as provided by Gander;
- engage in any conduct that would damage, harm, or diminish Gander’s reputation, goodwill, or public image; or
- represent or suggest that Gander endorses any user, business, product, or service, without our prior written consent.

- User Content
- Ownership of User Content. As between you and Gander, you own all of your User Content.
- Gander’s License to User Content. You grant to Gander a worldwide, non-exclusive, transferable, sublicensable, royalty-free and fully paid license to use, reproduce, modify, store, host, publish, translate, create derivative works from, distribute, share, publicly perform, and publicly display your User Content in connection with operating, providing, maintaining, developing, promoting and improving the Services and related features (e.g., content delivery, personalization, and safety/security functions) in a manner consistent with any privacy and application settings available on your User Account (the “User Content License”).
- Sublicensing and Transfer. The User Content License includes the right for Gander to: (A) sublicense User Content to its affiliates and service providers (including hosting, content delivery networks, moderation, analytics, customer support, and security vendors); and (B) transfer or assign the User Content License as part of a merger, acquisition, reorganization, or sale of assets of Gander.
- License Duration. The User Content License continues until your User Content is deleted from Gander’s systems. You may delete specific User Content through the Services, or you may delete your User Account to remove all User Content associated with your account, subject to the retention terms below.
- Deletion of User Content and Retention.
- Deletion Process. When you delete User Content (or your User Account), we will begin removing it from our active systems. Removal may not be immediate and may take time for technical reasons (for example, to maintain service integrity and prevent abuse).
- Retention for Legal and Safety Purposes. We may retain User Content (including deleted User Content) for longer than the ordinary deletion timeline where we reasonably believe it is necessary to: (I) comply with legal obligations or lawful requests; (II) enforce these Terms; (III) prevent fraud, abuse, or other harmful activity; (IV) protect the rights, property, and safety of users, third parties, and Gander; or (V) establish, exercise, or defend legal claims.
- Limits of Deletion. Notwithstanding anything to the contrary in these Terms: (I) deleting User Content from your User Account may not delete copies made or reposted by other users of the Services (for example, where another user re-posted your User Content, quoted it, or otherwise stored it), or cached User Content; and (II) Gander is not responsible for any such User Content that is copied or otherwise used by other users, or by third parties, even after termination of your User Account. Gander will apply deletion to the copies of your User Content we control that are associated with your User Account, subject to the retention terms herein. As a result, Gander cannot guarantee the complete deletion of your User Content from Gander’s Services at any point in time, and you release Gander of any and all claims relating to any such retained User Content on the Services following the deletion of your User Account.
- Removal of User Content for Violation of Terms. Without limiting any of its rights herein, Gander may remove or restrict any User Content that it determines, in its sole discretion, is in violation of these Terms. Gander makes no warranty or guarantee that our enforcement of these Terms will be consistent in every instance, or that User Content violating these Terms will necessarily always be removed (e.g., Gander may apply labelling to certain User Content to warn users instead of removing such content). You agree that Gander is not responsible for any decision to remove, decline to remove, or to label or restrict, any User Content, including where we remove, label or restrict content from some users but not others. Gander’s decisions about enforcement, prioritization, and moderation are made at our sole discretion and may be influenced by operational, technical, and safety considerations.
- Labelling of User Content. Without limiting any of its rights herein, Gander may, in its sole discretion, label certain User Content as offensive, graphic, AI-generated, misinformation, or other informative labels in order to warn other users of the Services. Users may report User Content to Gander if they believe it violates these Terms, and Gander will investigate such reports accordingly.
- Identity Verification. Gander may require identity verification in cases of suspected botting, impersonation, high-risk behavior, or other violation of these Terms. If you do not wish to comply with any verification requirement, Gander may, without any liability to you or any third party, revoke your access to the Services and terminate your User Account.
- Gander Content
The Services, including the text, graphics, images, audio, video and other material, as well as the taglines and look-and-feel (collectively, the “Gander Content”), as provided by Gander or its licensors, is protected by copyright, trademark and other such intellectual property laws in Canada, the United States and other countries. Unauthorized use of the Gander Content by you may violate copyright, trademark, and other intellectual property laws. The Services are solely and exclusively owned by Gander.
Subject to your compliance with these Terms, Gander grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services and the Gander Content solely for your personal, non-commercial use of the Services as intended by Gander. All rights not expressly granted to you are reserved by Gander and its licensors. Gander is and will remain the sole and exclusive owner of the Services.
Any suggestions or comments for improving or modifying the Services that are included in your communications with us (“Feedback”) will be deemed to be non-confidential and non-proprietary to you, and you agree that: (a) Gander may freely and irrevocably use, reproduce and publicize the Feedback; and (b) you are not, nor is any other party, entitled to receive any compensation or reimbursement of any kind from Gander in relation to the Feedback.
- Fees and Payment Processing
Access and use of certain features of the Services may require payment of a fee (“Service Fees”). Gander will use third party payment processors in order to facilitate Service Fee payments (the “Payment Processor”). Gander disclaims any and all liability that may result from your use of the Payment Processor, and makes no representation, warranty or guarantee with regard to the Payment Processor or their actions. Your activity on the Payment Processor’s sites or applications is governed by such Payment Processor’s terms and conditions. Any claim and dispute you may have in connection with Service Fees must be solely directed to such applicable Payment Processor, and you hereby release Gander, and its affiliates, and each of their officers, directors, employees and agents, from any and all claims, actions, demands or losses in connection with same.
- Disclaimers and Liability Limitation
YOU AGREE THAT YOU ACCESS AND USE THE SERVICES AT YOUR SOLE RISK.
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OR GUARANTEES WHATSOEVER, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FORGOING, THE SERVICES ARE PROVIDED WITHOUT IMPLIED OR EXPRESS WARRANTIES OR CONDITIONS OF MERCHANTABILITY, QUALITY, PERFORMANCE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL FUNCTION WITHOUT DEFECT, ERRORS, INTERRUPTION, OR DOWNTIME. BY USING OUR SERVICES, YOU AGREE THAT GANDER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, AFFILIATES, AND ASSIGNS ARE NOT LIABLE FOR ANY LOSS, HARM, DAMAGE, COST, OR INJURY SUFFERED (INCLUDING ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL OR EXEMPLARY DAMAGES) IN CONNECTION WITH YOUR ACCESSING, USING, OR THE INABILITY TO ACCESS, OR USE, THE SERVICES. BY ACCESSING OR USING THE SERVICES YOU AGREE THAT GANDER IS NOT RESPONSIBLE FOR YOUR ACTIONS OR JUDGMENTS IN CONNECTION WITH SAME.
NOTWITHSTANDING ANYTHING IN THESE TERMS, GANDER IS NOT RESPONSIBLE FOR: (A) THE ACTS OR OMISSIONS OF ANY USERS OF THE SERVICES OR THIRD PARTIES; OR (B) ANY OF THE USER CONTENT ON THE SERVICES, REGARDLESS OF ITS ORIGIN. EACH USER OF THE SERVICES IS SOLELY RESPONSIBLE FOR THE USER CONTENT THAT THEY PROVIDE TO THE SERVICES.
GANDER (INCLUDING OUR AFFILIATES, AND OUR AND THEIR OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES) IS NOT RESPONSIBLE FOR ANY DAMAGES OR LOSSES (INCLUDING LOSS OF MONEY, GOODWILL OR REPUTATION, PROFITS, OTHER INTANGIBLE LOSSES, OR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES) ARISING OR RESULTING DIRECTLY OR INDIRECTLY FROM: (A) YOUR USER CONTENT; (B) USER CONTENT OF OTHER USERS OF THE SERVICES, REGARDLESS OF WHETHER OR NOT SUCH USER CONTENT IS IN VIOLATION OF THESE TERMS, AND WHETHER GANDER HAS PERMITTED ANY SUCH VIOLATING USER CONTENT TO REMAIN ON THE SERVICES IN ANY INSTANCE; (C) YOUR USE OF OR YOUR INABILITY TO USE OUR SERVICES; (D) DELAYS OR DISRUPTIONS IN OUR SERVICES; (E) ANY ACTS OR OMISSIONS YOU TAKE IN THE COURSE OF USING THE SERVICES; (F) ANY RELIANCE YOU PLACE ON THE INFORMATION MADE AVAILABLE THROUGH THE SERVICES; (G) ANY GOODS, SERVICES OR INFORMATION YOU OBTAIN IN CONNECTION WITH YOUR USE OF THE SERVICES, OR ANY OTHER MATTER RELATING TO OR ARISING FROM YOUR USE OF THE SERVICES; OR (H) ANY ACTION TAKEN BY GANDER IN ACCORDANCE WITH THESE TERMS.
IN ANY EVENT, GANDER’S MAXIMUM AGGREGATE LIABILITY TO YOU UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF: (i) CAD $100.00; and (ii) THE TOTAL AMOUNT PAID BY YOU TO GANDER FOR THE SERVICES DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE FIRST EVENT GIVING RISE TO A CLAIM.
THE FOREGOING EXCLUSIONS AND LIMITATIONS WILL APPLY TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE WAIVED UNDER APPLICABLE LAW.
- No Professional Advice; Emergency Situations
The Services and any User Content made available through the Services are provided for general informational purposes only. Nothing on the Services constitutes, or is intended to constitute, professional advice (including legal, medical, financial, accounting, or other regulated advice). You should not rely on the Services as a substitute for professional advice tailored to your circumstances. If you require professional advice, you should consult a qualified professional.
If you believe you or someone else may be in immediate danger or needs urgent assistance, contact local emergency services immediately.
- User Disputes
Gander is not responsible for any disputes between users of the Services for any reason. If you have a dispute with one or more users of the Services, you release Gander (and our affiliates and subsidiaries, and our and their respective officers, directors, employees and agents) from any and all claims, demands and damages of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
- Third Party Sites
The Services may contain links or integrations to third party websites or applications that are not owned, maintained or operated by Gander (“Third Party Sites”). Gander is not responsible for the content of such Third Party Sites, and does not make any representations, warranties or guarantees regarding the content or the privacy practices of such Third Party Sites, regardless of who posts the links to such Third Party Sites (e.g., whether it is posted by Gander itself or any user of the Services). For certainty, Gander disclaims any liability associated with your access to, use of, download of, or reliance on, such Third Party Sites and their content. If you decide to access, use or otherwise interact with any such Third Party Sites or content, you do so at your sole risk.
- Reliance
You understand and agree that Gander is making the Services available to you in reliance upon the limitations and exclusions of liability, and the disclaimers set forth herein, and that the same forms an essential basis of the contract between you and Gander. You agree that the limitations and exclusions of liability, and the disclaimers set forth herein will survive and continue to apply in the case of a fundamental breach or breaches of, the failure of essential purpose of contract, the failure of any exclusive remedy or the termination of your access and use of the Services.
- Service Modifications
Gander reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice to you. This includes, without limitation, introducing payable features on the Services, or changing previously free features into payable features. To the maximum extent permitted under applicable law, Gander will not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Services.
- General
- Entire Agreement. These Terms, which incorporate by reference the Gander Privacy Policy, the Gander Community Guidelines, and any other policies posted by us on the Site or the App referencing these Terms, constitute the entire agreement between you and Gander with respect to the subject matter contained herein, and there are no other terms, conditions, representations, warranties, or collateral agreements, express or implied.
- Changes to these Terms. Gander may amend these Terms without notice or consent at any time and from time to time by posting the amended Terms on the Services. To the extent required by applicable law, Gander will notify you by email of any material amendments to these Terms. You can determine when these Terms were last amended by referring to the “Last Updated” reference expressly provided above. Your continued access or use of our Services after any amendments constitutes your acceptance of the amended Terms.
- Notices from Gander to You. Gander may provide notices or other communications to you by: (i) email to the email address associated with your User Account; (ii) in-app notifications; or (iii) posting notices on the Services.
- Assignment. Gander may assign these Terms, in whole, or in part, at any time, without notice or consent. You may not assign your rights or delegate your duties under these Terms, either in whole or in part, without Gander’s prior written consent in each instance.
- Non-Waiver. Our failure to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. Waivers will not be effective unless in writing and duly authorized by an officer of Gander.
- Severability. The invalidity or unenforceability of any provisions of these Terms will not affect the validity or enforceability of any other provisions of these Terms, which will remain in full force and effect. If a court of competent jurisdiction determines any provision(s) of these Terms to be invalid or unenforceable under applicable law, then: (i) to the maximum extent permitted under applicable law, the impugned provision(s) will be deemed to be amended so that they accomplish their original intent as closely as possible while remaining compliant with applicable law; and (ii) in the event such provision(s) cannot be so amended, then such provision(s) will be severed from these Terms, and the remainder of these Terms will remain in full force and effect.
- Interpretation of these Terms. These Terms are originally written in the English language. If and when Gander translates these Terms into another language, the English language text will prevail in the event of any inconsistency. Unless the context otherwise requires, words importing the singular include the plural and vice versa, and words importing gender include all genders. Where the word “including” or “includes” is used in these Terms, it means “including (or includes) without limitation”. Section headings used in these Terms are for convenience of reference only, and will not be used in the interpretation of these Terms. To the maximum extent permitted by applicable law, any rule of construction to the effect that any ambiguity in the provisions of these Terms is to be resolved against the author is not applicable in interpreting these Terms.
- Governing Law. These Terms are governed and interpreted pursuant to the laws of the Province of British Columbia, Canada and the federal laws of Canada applicable therein, without regard to principles of conflicts of law that would impose the law of another jurisdiction, and you agree to submit to the exclusive jurisdiction of the courts located within the Province of British Columbia, Canada. The foregoing will not limit Gander’s right to enforce these Terms in any other jurisdiction if reasonably necessary or advisable in Gander’s sole discretion.
- Trial Waiver. You hereby irrevocably and unconditionally agree to waive any right you may have to a trial by jury and to commence or participate in any class action against Gander related to the Services.
